1. Acceptance of terms
By using Xyphro ('Service'), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms — material changes will be notified at least 14 days in advance via email.
2. Service description
Xyphro is an AI WhatsApp chatbot platform that replies to your customers, captures leads, scores them, and syncs results to your CRM. We process customer messages, business data you upload, and conversation logs strictly to operate your bot.
3. Subscription billing
Plans are billed monthly or annually via Razorpay auto-debit (eMandate / UPI Autopay). All paid plans start with a 7-day free trial — no charge during the trial. The first charge happens automatically on day 8. Subsequent charges happen automatically at each billing cycle. You can cancel at any time from your client portal — cancellation takes effect at the end of the current billing cycle, with no further auto-debit.
4. Cancellation policy
You may cancel your subscription at any time. Upon cancellation, your account remains active until the end of the current billing period. After expiry, monitoring pauses and your data is preserved for 30 days. After 30 days, data may be permanently deleted unless you reactivate.

6. Data usage and scraping
We scrape only publicly accessible web pages and social media posts. We respect robots.txt where applicable and use rotating proxies through compliance-first vendors (Visualping, Apify). You are responsible for ensuring you have the right to monitor the URLs and accounts you add to your dashboard. We are not liable for misuse of competitor data.
7. Acceptable use
You agree not to use the Service to (a) violate any law, (b) harass or stalk individuals, (c) reverse-engineer the Service, or (d) attempt to scrape Xyphro itself. Violations may result in immediate account suspension without refund.
8. Limitation of liability
Xyphro is provided 'as is.' We make best efforts to ensure service availability but do not guarantee 100% uptime or message-delivery success (subject to WhatsApp / Meta and your CRM uptime). Total liability is limited to the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or business-loss damages.
9. Intellectual property
All software, AI models, dashboards and templates are property of Xyphro. The conversation logs and lead data we collect on your behalf are yours to use within your business. Reselling our underlying AI / platform without written permission is prohibited.
10. Governing law
These terms are governed by the laws of India. Disputes shall be resolved in the courts of Bhubaneswar, Odisha.
